Unless otherwise defined,all capitalized terms used in this privacy policy ("Privacy Policy") shall have the meaning given to them in the TOS / User Agreement (“Agreement”).

In addition to acceptance of the terms and conditions provided for under the User Agreement, the TOS for a particular Service and Amendments that may be made from time to time, You are required to accept the terms and conditions contained in this Privacy Policy to avail of any Services through www.saharaglobal.in All terms and conditions of the Agreement are incorporated by reference in this Privacy Policy and shall be deemed to be a part of this Privacy Policy.

SAHARA GLOBAL is committed to the complete security of information and transactions made by You. SAHARA GLOBAL hereby undertakes that: -

1. You can browse the site without telling us who you are or revealing any personal information about but to avail of the services provided by Sahara Global, you will need to submit your personal information in online booking form, where you may be required to provide SAHARA GLOBAL with your contact and other personal information as indicated in the forms throughout the site. 



2. Once you register the access to the Services and information available on www.saharaglobal.in is provided only through a valid login id and password provided to You upon registration with www.saharaglobal.in



3. In accordance with strict standards of security and confidentiality, Sahara Global shall ensure and safeguard all information that is provided by You to us. Wherever certain information is requested and necessary to enable You to access and use www.saharaglobal.in or the Service, SAHARA GLOBAL gathers such information, including personal information, so that SAHARA GLOBAL can better develop its relationship with You. You may choose not to share any such information with us, but in such case, You may not be able to take advantage of the features on www.saharaglobal.in



4. Information provided by You is an important part of Sahara Global's business and SAHARA GLOBAL is aware of the confidentiality requirements of such information. Therefore, SAHARA GLOBAL assures You that SAHARA GLOBAL is not in the business of selling or sharing any such information whatsoever with third parties, except to the extent necessary to provide Services as requested by You. If SAHARA GLOBAL uses your personal information and or comments for any commercial purposes whatsoever in the future. SAHARA GLOBAL will notify you at that time and allow you to opt out of having your information used for such purposes.



5. SAHARA GLOBAL has independent contracts with various Service Providers (Third Party Suppliers) to provide the Services and such Third Party Suppliers are provided with your personal information (only to the extent necessary) for the performance of the Services on a ‘need to know basis’, and are bound by confidentiality obligations similar to those contained in this Privacy Policy. However, SAHARA GLOBAL shall not be liable for any breach of confidentiality obligations on the part of the Services Providers and You shall defend, indemnify and hold harmless SAHARA GLOBAL against any claims in this regard.



6. SAHARA GLOBAL shall permit only employees and personnel of SAHARA GLOBAL or its affiliates/group companies, its financial and legal consultants and the Service Providers access to the information provided by You strictly on a 'need to know basis'.



7. Employees, Service Providers, and/or other external organizations, who violate Sahara Global’s confidentiality requirements under this Privacy Policy, shall be dealt with in accordance with the contracts governing their respective relationships with SAHARA GLOBAL and all applicable laws for the time being in force.



8. Additionally you may encounter “COOKIES” or other similar devices or certain pages of the sites that are placed by third parties ,we do not control the use of “COOKIES” by third parties.



9. The confidentiality restrictions in this Privacy Policy shall not apply where any information is:
   
   1. Required to be disclosed by, under or pursuant to any applicable law in force or pursuant to any order, decree, judgment, award, etc. of any court, tribunal or government authority;
   2. Disclosed to SAHARA GLOBAl’s legal or financial advisors or consultants;
   
   
   3. Already present in the public domain;
   
   
   4. Necessarily required to be disclosed in order to ensure that You avail of the Services under the applicable TOS; and
   
   
   5. Necessarily required to be disclosed to protect the rights, property or for personal safety of SAHARA GLOBAl’s, its users or the public.



10. SAHARA GLOBAL may update or modify this Privacy Policy from time to time. Such modifications shall be reflected in the Amendments posted on www.saharaglobal.in from time to time, which shall be binding on You.



11. You acknowledge that you have read this Privacy Policy and agree to all its terms and conditions. You have also independently evaluated the desirability of availing the Services on http://saharaglobal.in and are not relying on any representation, guarantee or statements other than as set out in this Privacy Policy.



12. ARBITRATION
    Any dispute or controversy arising out of or concerned with the this Policy shall be referred for adjudication to a Sole Arbitrator to be appointed by SAHARA SERVICE LTD the said Sole Arbitrator may be an employee or ex-employee of SAHARA SERVICE LTD or any of its sister/associates concern(s). You hereby approves of and grants your consent to this .The Sole Arbitrator shall follow the procedure as provided for in the (Indian) Arbitration & Conciliation Act, 1996 as amended from time to time and the award by the Sole Arbitrator shall be final & binding upon the parties. The seat of Sole Arbitrator shall be at Gurgaon, Haryana only and all proceedings shall be conducted in English



13. GOVERNING LAW AND JURISDICTION
    
    1. This TOS shall be governed by and constructed in accordance with the laws of India without reference to conflict of law principles.
    2. Subject to the Arbitration Clause above, the Courts of competent jurisdiction at New Delhi (India) only shall have exclusive jurisdiction over the subject matter.
    3. If any provisions(s) of this TOS is held by a court of competent jurisdiction to be contrary to applicable law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.
    4. Sahara Globals's failure to exercise or enforce any right or provision of this TOS shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Sahara Globals's in writing.
    5. The section titles in this TOS are solely used for the convenience of the parties and shall not be taken into account for the purposes of interpretation or construction.
    6. If any term or provision of this Agreement or the application to any person or circumstance shall, to any extent, be invalid or unenforceable, the remainder of this Agreement, or the application of such term or provision to persons or circumstances other than those as to which it is held invalid or unenforceable, shall not be, held invalid.
